I count myself fortunate to have retained David Mulroney as my legal counsellor. He came highly recommended and, I can understand why.
I was assessed a $27,000 fine by my Strata Council which I thought was unfair and unjustified and the Strata successfully obtained, in my opinion, an unfair judgment to enforce it from the Civil Resolution Tribunal, where I self represented. I was referred by another lawyer to Mr. David Mulroney to consider a Judicial Review of the CRT decision. Mr. Mulroney warned me in advance that if he lost, I would end up paying both his fee and the assessed fine. He informed me that judicial reviews were difficult and he warned me that if he was of the opinion there could be no successful review, my money would be wasted. He quoted me a fair fee to look at the review to see if it would work. When his opinion was that it would likely be reversible, he quoted a very fair fee which was generous to me and tailored lower to reflect the amount at stake. His fees at his rates would have made the matter uneconomical, but he saw an injustice and agreed to try to remedy it. He drafted and filed the Judicial Review petition within the review deadline. His arguments and he were so persuasive that the Strata Council, after legal advice, agreed to set aside the fine and the CRT and the Attorney General decided not to intervene, so the matter was reversed by consent order without a court hearing. The other side had offered to simply not collect on the judgment, but Mr. Mulroney agreed to push for a court order to clear my name and erase the fine judgment, because it was not just about the money but rather maintaining the reputation and integrity of me, his client.
I found Mr. Mulroney to be extremely professional and straight forward. His meticulous approach and quality of work was exemplary. He kept me up-to date throughout the six month ordeal and he ensured I understood all the possible legal outcomes and ramifications. I would highly recommend David Mulroney to anyone who is looking for quality legal counsel.
